These Terms of Service apply when you use hultonsmerchant.com or buy products from Hultons Merchant. By using the website or placing an order, you agree to these terms. Nothing in these terms affects your statutory rights.

2. Website use
You may use this website only for lawful purposes. You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, or use website content in a way that infringes our or another person's rights.
3. Product information
We take reasonable care to describe products accurately. Images are illustrative and colours, finishes or packaging may vary slightly. Measurements and compatibility information should be checked before purchase. If you are unsure whether a product is suitable, contact us before ordering. Installation should be completed by a suitably competent person where required.
4. Prices and VAT
Prices are shown in pounds sterling. The website identifies whether displayed prices include or exclude VAT; the final amount payable, including VAT and delivery charges, is shown at checkout before you place your order. We may change prices at any time, but this will not affect an order already accepted.
5. Orders and contract formation
Submitting an order is an offer to buy. We will acknowledge receipt electronically, but a contract is formed only when we confirm acceptance or dispatch the goods. We may reject or cancel an order before acceptance if a product is unavailable, pricing or product information contains an obvious error, payment is not authorised, or we reasonably suspect fraud or misuse. If payment has already been taken for a cancelled order, we will refund it.
6. Payment
You must provide complete and accurate billing and contact information. Payment is processed using the methods offered at checkout. You confirm that you are authorised to use the chosen payment method.
7. Availability and delivery
Stock information and dispatch estimates are not guarantees. Some products may be available to order while replenishment is pending. Delivery options, charges and current estimates are shown at checkout. We are not responsible for delays outside our reasonable control, but we will contact you where a significant delay affects your order and explain your options.
8. Risk and ownership
Risk in the goods passes to you when they are delivered to you or a person you nominate. Ownership passes when we receive payment in full.
9. Consumer cancellation and returns
If you are a consumer buying online, you normally have the right to cancel within 14 days after receiving the goods, subject to legal exceptions. You then have a further 14 days to return the goods. Items should be returned complete and, where reasonably possible, in their original condition. You are responsible for return costs unless the item is faulty, not as described, or we agree otherwise. The cancellation right may not apply to made-to-measure, personalised, sealed hygiene-sensitive, or other legally excluded goods once the relevant conditions are met.
10. Faulty or incorrect goods
If goods are faulty, damaged, not as described, or incorrect, contact us promptly with your order details. Consumers have rights under the Consumer Rights Act 2015, including remedies that may include repair, replacement, price reduction or refund depending on the circumstances. These rights are not limited by these terms.
11. Business customers
If you buy wholly or mainly for business use, you confirm that you have authority to bind that business. To the fullest extent permitted by law, we are not liable to business customers for indirect or consequential loss, loss of profit, revenue, business, contracts, anticipated savings or goodwill. Our total liability arising from an order will not exceed the amount paid for that order, except where liability cannot lawfully be limited.
12. Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot be excluded. Subject to this, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused by incorrect installation, misuse, normal wear, or failure to follow instructions.
13. Intellectual property
The website and its content, including text, design, graphics, logos and software, are owned by or licensed to us. You may use the website for personal or internal business purchasing purposes, but may not reproduce or commercially exploit its content without permission.
14. Third-party services
The website may use or link to third-party services, including payment and delivery providers. Their own terms and privacy notices may apply. We are not responsible for third-party websites that we do not control.

17. Governing law
These terms are governed by the laws of England and Wales. Consumers who live elsewhere in the UK retain any mandatory protections and may bring proceedings in the courts available under applicable law. Business customers agree that the courts of England and Wales have exclusive jurisdiction.
